Terms of Service

Welcome to SparkChambers. These Terms of Service ("Terms") govern your access to and use of our platform, including our website, mobile applications, and all related services (collectively, the "Service"). SparkChambers is an adult dating and social platform designed for consenting adults to connect and meet like-minded individuals.

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. When you create an account with SparkChambers, you agree to the following:

• Maintain only one account per person (couple accounts are permitted for verified couples)

• You may not share your account credentials with any third party
• You may not transfer your account to another person without our prior written consent

You agree to:

• Respect the boundaries and consent of other users at all times
• Report any inappropriate, abusive, or illegal behavior you encounter
• Use the platform only for its intended purpose of meeting and connecting with other adults

You agree NOT to:

• All users must be 18 years or older to view or upload adult content
• User-generated content remains the sole responsibility of the user who uploads it
• SparkChambers reserves the right to review, moderate, remove, or restrict any content at our discretion
• All content depicting individuals must feature only consenting adults who are 18 years or older
• No content depicting or promoting non-consensual activities
• No content that is illegal under German law or the laws of your jurisdiction
• By uploading content, you grant SparkChambers a non-exclusive, worldwide, royalty-free license to display, distribute, and modify the content for the purpose of operating the Service

Available Subscription Tiers

• Basic: Free tier with limited features and functionality
• Plus: Enhanced features with monthly billing, including extended messaging and visibility options
• Premium: Full access to all features with monthly billing, including priority support and advanced search filters

Billing Terms

• All subscriptions automatically renew at the end of each billing period unless cancelled
• Payment is charged at the beginning of each billing period
• Subscription prices are subject to change with 30 days advance notice
• No refunds are provided for partial billing periods
• All prices are displayed in Euros (EUR) and include applicable taxes

Cancellation Policy

• You may cancel your subscription at any time through your account settings
• Upon cancellation, you will continue to have access to premium features until the end of your current billing period
• To avoid being charged for the next billing period, you must cancel at least 24 hours before your renewal date
• EU consumers have a 14-day withdrawal right from the date of purchase, unless the service has already been fully performed with your express consent

Your privacy is important to us. The processing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. SparkChambers is fully compliant with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

SparkChambers may share your data with law enforcement authorities when legally required to do so, or when necessary to protect the safety of our users or the public.

SparkChambers Owns

• The SparkChambers name, logo, and all associated branding and trademarks
• The website and application design, layout, and user interface
• All proprietary technology, software, algorithms, and code
• All original content created by SparkChambers

Users Retain

• Ownership of all content you create and upload to the platform
• By uploading content, you grant SparkChambers a non-exclusive, worldwide, royalty-free license to display, distribute, reproduce, and modify the content for the purpose of operating and promoting the Service
• This license continues for as long as your content remains on the platform

Users Must Not

• Copy, reproduce, or distribute any SparkChambers content without permission
• Use SparkChambers trademarks or branding without written authorization
• Reverse engineer, decompile, or disassemble any part of the Service
• Create derivative works based on the Service or its content

SparkChambers provides a platform for adults to connect, but we are not responsible for the behavior of users either on or off the platform. We do not perform background checks on users, and we cannot guarantee the accuracy of information provided by users in their profiles.

SparkChambers may intervene in user disputes or reports of misconduct, but we have no obligation to do so. Users are solely responsible for their own safety and the consequences of their interactions with other users.

Limitation of Liability

• SparkChambers is not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for lost profits, lost data, loss of goodwill, or business interruption
• Our maximum aggregate liability to you shall not exceed the amount you paid to SparkChambers in the 12 months preceding the claim
• These limitations apply regardless of the legal theory on which the claim is based

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability is limited to the fullest extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless SparkChambers, its owner Daniel Samer, and any affiliates, contractors, or service providers from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service or any activities conducted through your account
• Content you upload, post, or transmit through the Service
• Your violation of these Terms or any applicable law or regulation
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your interactions with other users, whether online or offline
• Any dispute between you and another user

SparkChambers May Terminate or Suspend Your Account

• For violating these Terms or our community guidelines
• For engaging in illegal activity or activity that harms other users
• For extended periods of inactivity (typically 24 months or more)
• At our discretion with reasonable notice for any reason not prohibited by law

Upon Termination

• You will immediately lose access to your account and all content
• Some data may be retained as required by law or for legitimate business purposes
• You may request a copy of your data before termination (data portability)
• Certain provisions of these Terms will survive termination, including intellectual property rights, indemnification, limitations of liability, and dispute resolution

• These Terms are governed by and construed in accordance with the laws of Germany
• Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Duisburg, Germany
• If you are an EU consumer, you may also bring proceedings in the courts of your country of residence
• Before initiating any legal proceedings, we encourage you to contact us to attempt to resolve any dispute amicably

• SparkChambers reserves the right to update or modify these Terms at any time
• Material changes will be communicated to you via email or through a prominent notice on our platform
• Your continued use of the Service after any changes constitutes acceptance of the new Terms
• If you do not agree with the changes, you must stop using the Service and terminate your account
• We recommend reviewing these Terms periodically to stay informed of any updates

• These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and SparkChambers
• Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision
• If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect
• You may not assign or transfer your rights under these Terms without our prior written consent
• SparkChambers may assign its rights and obligations under these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets
• Headings in these Terms are for convenience only and shall not affect interpretation
